WHO MAY ENTER: The Wheel Game (“Game”) is open to legal residents of the fifty (50) United States (including the District of Columbia) age eighteen (18) or older at time of entry who attend BLAST Premier Spring Finals (“Event”) occurring from June 9-11, 2023 (collectively referred to hereafter as “you” or “Entrant”) at WASHINGTON D.C SPORT & ENTERTAINMENT ARENA (1100 Oak Dr SE, Washington, DC 20032). Employees (and their immediate families [spouse, parent, child, sibling and their respective spouses], regardless of where they reside or those living in the same households, whether or not related) of Eureka Ergonomic (the “Sponsor”) and their respective parent companies, affiliates, subsidiaries, prize supplier(s), content provider partners, mobile competitors, distributors and advertising and promotion agencies involved in this Giveaway (collectively, the “Giveaway Parties”) plus any person acting in the course of their employment, in a business capacity, in pursuit of any business interests, whether for a fee or otherwise, any person representing and/or affiliated with or related to a Non-U.S. government entity or who is a Non-U.S. government official, is not eligible to participate or win. Giveaway is subject to all federal, state, and local laws and regulations. Void where prohibited or restricted by law.

BY PARTICIPATING IN THE GAME, EACH ENTRANT REPRESENTS AND WARRANTS HE OR SHE MEETS THE ELIGIBILITY REQUIREMENTS STATED IN THESE TERMS AND CONDITIONS (“T&Cs”) AND ACKNOWLEDGES THAT FAILURE TO MEET ALL ELIGIBILITY REQUIREMENTS WILL DISQUALIFY ENTRANT FROM THE GIVEAWAY.

GAME PERIOD: Game begins on or about 10:00 a.m. Eastern Time (“ET”) on June 9th, 2023, and ends on or about 5:00 p.m. PT on June 11th, 2023 (“Game Period”).

HOW TO PARTICIPATE: During the Game Period, visit the Sponsor’s booth at the Event and consult with the Eureka Ergonomic representative (“Rep”) who will provide you a chance to participate. Entrants are allowed one (1) spin during the Game Period. To play, spin the wheel and it will start turning until it stops. If it lands on a “prize” slice randomly chosen by the marker on a slice when the wheel stops, the Entrant will win the prize listed on the slice.  All prizes are awarded on a first come and play basis. If a prize is not available, it will be replaced with a different prize at the Rep’s sole discretion. Odds of winning depend on the number of Game prizes available to be claimed.

The Rep, in its sole discretion, reserves the right to disqualify any Entrant who engages in any conduct the Rep deems to be improper, unfair, or detrimental to other Entrants.

ALL PRIZES ARE AWARDED AS IS. Each MSRP stated herein is what the prize is currently known to be selling for at the time the T&Cs were published and is subject to change. If the prize value is lower than the stated value at time of award, the difference will not be awarded.

The prize will not be delivered or shipped to the winner's address. It is the winner's responsibility to make necessary arrangements to collect the prize.

Selection of prizes to be awarded is at the Sponsor’s sole discretion. Any unclaimed prize remaining after the end of the Game Period will not be awarded. Winners may be responsible for all federal, state, and local sales and income taxes on prize, if any. No substitution for any prize, except the Sponsor or its Rep reserves the right, in its sole discretion, to substitute any prize with a different prize. Prizes are not transferable or redeemable for cash. Prize details are at Sponsor’s sole discretion. Winners acknowledge the Sponsor and its agents do not make, nor are in any manner responsible for, any warranty, representations, expressed or implied, in fact or in law, relative to the quality, conditions or fitness of any aspects of the prizes except each prize is subject to its manufacturer's standard warranty, if any. Limit: one (1) prize per winner.

SUSPENSION / MODIFICATION / TERMINATION The Sponsor reserves the right to modify, suspend or terminate the Game without notice, if in its sole and absolute discretion, it is determined that it is or a portion of it is technically impaired or corrupted or that fraud or technical problems, failures or malfunctions or any Force Majeure event(s) has destroyed or severely undermined or impaired the integrity and/or feasibility of the Game, and, if suspended or terminated, any unclaimed prize will not be awarded.

Game Parties are not responsible for inaccurate registration information, hardware and/or software failures of any kind, or for any problems or technical malfunctions or for registrations not received by Sponsor or its agent on account of technical problems, slow wi-fi service or connectivity issues, or for any other errors of any kind relating to or in connection with the Game, whether technical, mechanical, typographical, human, or otherwise, including, without limitation, errors which may occur in connection with the administration of a Game. Winners further acknowledge that the forfeiture of the prize and/or return of prize shall in no way prevent Sponsor from pursuing other avenues of recourse such as criminal or civil proceedings in connection with such conduct. Should any portion of the Game be, in Sponsor’s sole decision, compromised by non-authorized human intervention or other causes which, in the sole decision of Sponsor, corrupt or impair the administration, security, fairness or proper play, the Sponsor reserves the right, in its sole discretion, to terminate the Game. If any legal or regulatory authority disputes the Game, the Sponsor reserves the right to terminate or modify the Game. CAUTION: ANY ATTEMPT BY ANY ENTRANT TO UNDERMINE THE LEGITIMATE OPERATION OF THE GAME MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH ENTRANT OR PERSON TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.

MISCELLANEOUS CONDITIONS: By participating, Entrants: (i) agree to be bound by these T&Cs, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor’s Rep which are final and binding in all matters relating to the Game. Failure to comply with these T&Cs may result in disqualification. Sponsor reserves the right to permanently disqualify any Entrant it believes has intentionally violated these T&Cs.

RELEASES: Entrants agree to these T&Cs and the decisions of the Sponsor and release, defend and hold harmless Game Parties, as well as their employees, officers, directors and agents of each, from all claims, actions and all liability of any kind whatsoever for injuries, damages or losses of any kind, which may be sustained in connection with, either directly or indirectly, (1) the awarding, receipt, ownership, use or misuse of any prize awarded herein; or (2) participation in any game-related activities. The Sponsor is not responsible for any typographical or any other errors in the printing or advertising of the offer, administration, or announcement of the Game or prizes.

LIMITATION OF LIABILITY: The Game Parties will not be liable to any Entrant for any indirect, incidental, consequential, punitive, or special damages whatsoever arising out of, in connection with, or in any way relating to this Game or these T&Cs, or the breach thereof, regardless of the legal theory upon which any claim for damages is based, whether based on tort (including negligence), breach of contract or breach of warranty by any party. The foregoing exclusion will apply even if a party has been advised of the possibility of the damages in advance and even if any available remedy fails of its essential purpose. In addition, any and all disputes, claims and causes of action arising out of, in connection with or relating to this Game or any prize awarded shall be resolved individually, without resort to any form of class action. The entire liability of Game Parties (and the sole and exclusive remedy of Entrant and any of its affiliates and agents), for any claim or cause of action arising hereunder (whether in contract, tort, or otherwise) shall not exceed one hundred United States dollars (US$100.00).

ARBITRATION AND CHOICE OF LAW: Except where prohibited by law, all matters arising out of, in connection with or relating to this Game or the enforcement or construction of these T&Cs shall be governed by and resolved in accordance with the laws of the State of California, U.S.A., without regard to any conflict of law principles that would result in the application of the laws of a different jurisdiction. Sponsor and Entrants each hereby: (i) agree that any suit, action or other legal proceeding arising out of, in connection with or relating to this Game shall be brought and adjudicated only in a court of competent jurisdiction located in San Diego, California; (ii) consent to and waive any objection to the personal jurisdiction and venue of such court in any such suit, action or other legal proceeding; and (iii) waive any purported right or claim to bring a motion to transfer such suit, action or other legal proceeding pursuant to 28 U.S.C. §§1404 or 1406, or comparable provision of other law, including based upon the doctrine of forum non conveniens.

By participating in Game, each Entrant, or Entrant’s parent or legal guardian if Entrant is a minor, expressively waives and relinquishes all rights and benefits afforded by California Civil Code 1542 and does so understanding and acknowledging the significance of this waiver. Section 1542 states as follows: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DID NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN, BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR THE GAME PARTIES.”

SEVERABILITY: If any provision or part-provision of these T&Cs is or becomes invalid, illegal, or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of these T&Cs.

PRIVACY: Information collected from any Entrant will be processed according to Sponsor’s Privacy Policy at Qualcomm.com/site/privacy, including how the data subject rights can be exercised. Any requested opt-in consent is completely voluntary and will not increase your chances of winning. Sponsor does not sell your personal information, as the term “sell” is defined by the California Consumer Privacy Act of 2018
